time or Hobbs time exceeds 1000 hours, whichever comes first. The Aircraft Paint & Graphics Warranty shall extend for 365 days after the warranty activation date. The warranty activation date means the first to occur of (a) delivery of the aircraft to a purchaser which intends to use it for commercial or private use, (b) the date on which the Aircraft’s tachometer time or Hobbs time exceeds 100 hours or (c) twelve months after the Aircraft is shipped from Piper’s factory. 3. Parties to Which Warranty is Extended: Piper’s Limited Warranty on Aircraft shall extend to the initial purchaser of the Aircraft and any other person or entity to which title to the Aircraft is transferred during the applicable warranty term. 4. Scope of Warranty; Remedies: PIPER’S SOLE LIABILITY UNDER THIS LIMITED WARRANTY on Aircraft shall be, at Piper’s option, to repair or replace any defective portion of the Aircraft which fails during the applicable warranty period. Parts and labor used in performing Piper’s obligations under the limited warranty shall be at Piper’s expense. Piper may provide and use repaired, rebuilt, modified, overhauled, in-service, remanufactured, and/or new parts for warranty repairs as determined by Piper in its sole discretion. All warranty work must be performed by an authorized Piper Service Center rated to perform maintenance on the specified model of Aircraft (or by Piper at its factory if requested by Piper). 5. Procedure for Obtaining Warranty Service: In order to qualify under this Limited Warranty, the owner must notify an authorized Piper Service Center of the defect within thirty (30) days of discovery and promptly deliver the Aircraft to an authorized Piper Service Center, or if requested by Piper, to Piper’s factory. Upon receipt of such Aircraft, if it is not found to qualify for warranty service as described herein, the owner shall be responsible for all expenses associated with analysis and evaluation of the aircraft. In addition, all costs and expenses associated with transporting Aircraft, replacement parts, or components to and from the Piper factory or a Piper Service Center shall be paid by the owner. 6. Parts and Components Covered: Piper’s Limited Warranty on Aircraft shall cover any replacement part or component installed pursuant to this Limited Warranty but shall terminate upon the expiration of the aircraft limited warranty period. All parts and components included in the Aircraft upon its shipment from Piper’s factory or subsequently installed as described above are subject to the warranty described herein, except for the parts and components not covered (see Section 7). 7. Parts and Components Not Covered: The following parts and components are not covered by Piper’s limited warranty: a) Engines, engine accessories, propellers, avionics, and automated flight systems. Any warranty or consideration of warranty of these parts and components is provided directly by the original manufacturer and its applicable terms and conditions are provided with each aircraft at the time of delivery. b) Any part or component that shall have been subject to abuse, misuse, negligence, accident or natural disaster, including but not limited to lightning, hail storm, tornado, acts neither foreseen nor controlled and commonly defined as force majeure. c) Expendable items that would normally be replaced within the warranty period including by way of example only but not limited to air filters, oil filters, tires, batteries, exhaust gas temperature probes, brake linings, and brake discs. d) Any part that has reached its designed life limit. e) Any part, component or paint that shall have deteriorated from normal wear or exposure. f) Paint shine/gloss. g) All normal paint maintenance that includes touch-up of abrasion and wear of the paint on the nose, cowl, wing tip leading edges, vertical and horizontal stabilizer tips, windshield retainers, and other leading edge surfaces. 8. Items Which May Void The Warranty: The following items will affect warranty coverage of your aircraft and may result in the Piper Aircraft Limited Warranty being voided entirely. a) If and when any modifications are made to the aircraft, it is the owner’s responsibility to inform New Piper Aircraft, Inc. in writing of any and all such modifications. Direct all correspondence to the attention of the Warranty Department at: Piper Aircraft, Inc. 2926 Piper Drive Vero Beach, Florida 32960 USA Failure to notify Piper of any and all modifications may result in withholding warranty coverage in whole or in part. b) A lightning strike. c) The Aircraft Paint & Graphics Warranty will be voided if it is determined that the aircraft care instructions have not been followed. d) Failure to comply with the requirements listed on the first fifty (50) hours inspection report may cause the affected systems to fail prematurely and will reduce or void warranty coverage of the systems. e) Any accident or incident to the aircraft may reduce or void the warranty. 9. Design Changes: Piper reserves the right to make changes in the design or material of its products without incurring any obligation to incorporate such changes in any product previously manufactured. 124-024 (Rev. 11-07) 10. Exclusions and Disclaimers: THE LIMITED WARRANTY DOES NOT EXTEND TO NORMAL MAINTENANCE SERVICES (SUCH AS ENGINE TUNE-UP, COMPONENT OVERHAUL, CLEANING, CONTROL RIGGING, BRAKE, OTHER MECHANI- CAL ADJUSTMENTS AND MAINTENANCE INSPECTIONS INCLUDING REPETITIVE INSPECTIONS REQUIRED BY PIPER SERVICE BULLETINS OR FAA AIRWORTHINESS DIRECTIVES) OR TO ANY DEFECT DUE TO THE NEGLIGENCE OF OTHERS, FAILURE TO OPERATE OR TO MAINTAIN THE AIRCRAFT, PARTS OR COMPONENTS IN ACCORDANCE WITH APPLICABLE INSTRUCTIONS (AS HEREINAFTER DEFINED), ABUSE, UNREASONABLE USE, ACCIDENTS, ALTERATIONS, INCIDENTS, AND OR NORMAL WEAR AND TEAR. MODIFICATIONS DONE TO THE AIRCRAFT MAY AT THE DISCRETION OF PIPER AIRCRAFT VOID WARRANTY COVERAGE OF THE AFFECTED SYSTEMS OF THE AIRCRAFT. IN SOME CASES, DEPENDING ON THE NATURE OF THE MODIFICATION, THE MODIFICATION MAY VOID THE ENTIRE LIMITED AIRCRAFT WARRANTY. When a non-Piper approved STC installation is incorporated on the airplane, those portions of the airplane affected by the installation must be inspected in accordance with the inspection program published by the owner of the STC. Since non-Piper approved STC installations may change systems interface, operating characteristics and component loads or stresses on adjacent structures, Piper provided inspection criteria may not be valid for airplanes with non-Piper approved STC installations. All inspection intervals, replacement time limits, overhaul time limits, the method of inspection, life limits, cycle limits, etc., recommended by Piper are solely based on the use of new, repaired, rebuilt, modified, overhauled in- service, or remanufactured Piper approved parts. If parts are designed, manufactured, remanufactured, overhauled and/or approved by entities other than Piper, then the data in Piper’s maintenance/service manuals and parts catalogs are no longer applicable and the purchaser is warned not to rely on such data for non-Piper parts. All inspection intervals, replacement time limits, overhaul time limits, the method of inspection, life limits, cycle limits, etc., for such non-Piper parts must be obtained from the manufacturer and/or seller of such non-Piper parts. For purposes of this Limited Warranty, “applicable instructions” shall include all manuals, bulletins, advisories, operating and maintenance instructions, customer service information, notices and similar information issued from time to time by Piper or applicable manufacturers and all airworthiness directives and other rules and regulations issued from time to time by the Federal Aviation Administration. NO OTHER WARRANTY, WHETHER OF MERCHANTABILITY, FITNESS OR OTHERWISE, EXPRESSED OR IMPLIED IN FACT OR BY LAW, IS GIVEN BY PIPER WITH RESPECT TO ANY AIRCRAFT, PART, COMPONENT, OR SERVICE, AND NO OTHER OR FURTHER OBLIGATION OR LIABILITY SHALL BE INCURRED BY PIPER BY REASON OF THE MANUFACTURE, SALE, LEASE OR USE OF ANY AIRCRAFT, PART, COMPONENT, OR SERVICE, WHETHER ON GROUNDS OF BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. In the event that the provisions relieving Piper of liability for any reason are held ineffective, the remainder of this paragraph shall remain in full force and effect. The obligation of Piper set forth in Section 4 for obtaining warranty service shall be the exclusive remedy for any warranty obligation. IN NO EVENT SHALL PIPER BE LIABLE FOR ANY GENERAL, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES RELATING TO PROPERTY DAMAGE OR ECONOMIC LOSS, INCLUDING WITHOUT LIMITATION, ANY DAMAGES FOR LOSS OF USE OR LOSS OF PROFITS. If for any reason a court of competent jurisdiction enters a final judgment holding that the remedy provided for herein has failed of its essential purpose, Piper shall not in any event be liable for an amount in excess of the price paid for the allegedly defective Aircraft. No other person or entity (including any agent or employee of Piper) is authorized to extend any other or further warranty or incur any additional obligation on Piper’s behalf in connection with the sale of its products.
