FEDERAL AVIATION ADMINISTRATION 4 Feb 71 IMPLEMENTATION OF NOISE TYPE CERTIFICATION STANDARDS SUBJ: 1 . PURPOSE. This order assigns responsibilities for the implementation of noise type certification standards.
2. DISTRIBUTION. This order is distributed to the Administrator, Associate Administrator for Operations, Associate Administrator for Plans, Director Director of Environmental Quality, Assistant of Budget, General Counsel, Assistant Administrator Administrator for International Aviation Affairs, for General Aviation Affairs; branch chiefs and above in Flight Standards offices in Washington, regions, NAFEC, Aeronautical Center and area offices; copies to all GADOs, ACDOs, EMDOs, IFOs, and FSDOs.
. BACKGROUND.
a. The Office of Environmental Quality is responsible for developing and managing a program to achieve a system solution to the aircraft noise abatement problem, including the development of noise certification standards and rules.
b. FAR 36 prescribing noise standards for issuance of type certificates, and changes thereto, for subsonic transport category airplanes and for all subsonic turbojet powered airplanes became effective 1 December 1969. FAR 21 was also amended at that time to incorporate procedural changes made necessary by the addition of new Part 36.
Rulemaking projects establishing noise type certification standards for other categories of aircraft are in various stages of completion.
4 l ASSIGNMENT. Implementation of the noise type certification regulations can be accomplished most effectively and efficiently in conjunction with the performance of airworthiness type certification activities.
Accordingly, responsibility for implementing the noise type certification regulations is hereby assigned to the Engineering and Manufacturing elements of the regional Flight Standards Divisions, the Aircraft Engineering Division, Western Region, and the Aircraft Certification Staff, Europe, Africa, and Middle East Region.
5 a RESPONSIBILITIES. The respective responsibilities of the regions and the Office of Environmental Quality with respect to the implementation of noise type certification standards are as follows: Distribution: w~A/oP/PL/BU/GC/EQ/IA/GA-1; WRMCNFS-3; Initiated By: FS-103 FFS-1, 2, 3, 5, 7(minimum) 1100.128 4 Feb 71 a. Regions. For noise type certification programs involving applicants located within their geographical boundaries, the Engineering and Manufacturing organizations identified in paragraph 4 above shall: (1) Determine compliance or noncompliance with noise type certifi- cation regulations except for approval of equivalent means of compliance where such approval is specifically provided for in a noise type certification regulation (such as Sections 36.101, 36.103, and C36.1).
(2) Submit requests for approval of equivalent means of compliance to Flight Standards Service for disposition by the Office of Environmental Quality and, following approval, determine compliance or noncompliance with these means of compliance.
(3) As requested, furnish any information deemed necessary by the Flight Standards Service, or by the Office of Environmental Quality in consultation with Flight Standards Service, for review and direction of findings of compliance or noncompliance, or deemed necessary to determine the need for further regulatory action or to otherwise further the objectives of the FAA's Noise Abatement Program.
(4) Provide technical expertise necessary to ensure that the highest degree of safety is achieved in the administration of noise type certification regulations, and inform the Office of Environmental Quality through Flight Standards Service, of any administrative or regulatory actions necessary to achieve that end.
b. The Flight Standards Service shall: (1) Serve as focal point for communication with the regions on matters of compliance, procedures and policy, and all matters requiring consultation with the Office of Environmental Quality, (2) Maintain close liaison with the regions on noise certification matters to ensure uniformity of application and compatibility with airworthiness type certification procedures.
c. The Office of Environmental Quality shall: (1) Provide technical advice and guidance to Flight Standards Service as required to ensure proper implementation of the noise certification standards consistent with the objectives of the FAA's Noise Abatement Program.
(2) Process all requests for approval of equivalent means of com- pliance where such approval is specified in a noise type certification regulation Page 2 Par 5 1100.128 4 Feb 71 (3) In coordination with Flight Standards Service, provide for acoustical training for personnel engaged in the noise type certification of aircraft.
