Qatar Civil Aviation Regulation No. 1003/2006

Note. - When the word aircraft is used, it includes the remotely piloted aircraft. (d) Aircraft avionics. A term designating any electronic device - including its electrical part - for use in an aircraft, including radio, automatic flight control and instrument systems. (e) Airworthiness limitation section. (ALS) means a section in the instructions for continued airworthiness, as required by points 21.A.61, 21.A.107 and 21.A.120A of Annex (Part 21) to QCAR 1002/2006, that contains airworthiness limitations that set out each mandatory replacement time, inspection interval and related inspection procedure; (f) Appropriate airworthiness requirements. The comprehensive and detailed airworthiness codes established, adopted or accepted by a Contracting State for the class of aircraft, remote pilot station, engine or propeller under consideration. (g) Approved maintenance organization. An organization approved by the Authority, in accordance with the requirements of this Regulation, to perform maintenance of aircraft, engine, propeller or parts thereof and operating under supervision approved by the Authority. Note - Nothing in this definition is intended to preclude that the organization and its supervision be approved by more than one State. (h) Baseline structure. refers to the structure that is designed under the type certificate for that aeroplane model (that is, the ‘as delivered aeroplane model configuration’). (i) Certifying staff. Personnel responsible for the release of an aircraft or a component after maintenance. (j) Commercial Air Transport (CAT). An aircraft operation to transport passengers, cargo or mail for remuneration or other valuable consideration. (k) Commercial specialised operations. Those operations subject to the requirements of Part-ORO, Subpart-SPO set out in QCAR 002/2016 Air Operations regulation. (l) Competition flight. As defined in QCAR 002/2016 Air Operations regulation. (m) Complex motor-powered aircraft. Means: (a) an aeroplane: (i) with a maximum certificated take-off mass exceeding 5 700 kg, or (ii) certificated for a maximum passenger seating configuration of more than nineteen, or (iii) certificated for operation with a minimum crew of at least two pilots, or (iv) equipped with (a) turbojet engine(s) or more than one turboprop engine, or Qatar Civil Aviation Regulation No. 1003/2006 iv as amended by QCAR 097 of 2022 (b) a helicopter certificated: (i) for a maximum take-off mass exceeding 3 175 kg, or (ii) for a maximum passenger seating configuration of more than nine, or (iii) for operation with a minimum crew of at least two pilots, or (c) a tilt rotor aircraft. (n) Component. Any engine, propeller, part or appliance. (o) Continuing airworthiness. The set of processes by which an aircraft, remote pilot station, engine, propeller or part complies with the applicable airworthiness requirements and remains in a condition for safe operation throughout its operating life. (p) Continuing airworthiness records. Records which are related to the continuing airworthiness status of an aircraft, engine, propeller or associated part. (q) Contracting State. A State which is a signatory to the Convention on International Civil Aviation of 7th December 1944. (r) Corrosion prevention and control programme. (CPCP) means a document reflecting a systematic approach to prevent and to control corrosion in an aeroplane’s primary structure, consisting of basic corrosion tasks, including inspections, areas subject to those tasks, defined corrosion levels and compliance times (implementation thresholds and repeat intervals). A baseline CPCP is established by the type certificate holder, which can be adapted by operators to create a CPCP in their maintenance programme specific to their operations. (s) Critical maintenance task. A maintenance task that involves the assembly or any disturbance of a system or any part on an aircraft, engine or propeller that, if an error occurred during its performance, could directly endanger the flight safety. (t) Damage tolerance evaluation. (DTE) is a process that leads to a determination of maintenance actions necessary to detect or preclude fatigue cracking that could contribute to a catastrophic failure. When applied to repairs and changes, a DTE includes the evaluation of the repair or change and the fatigue critical structure affected by the repair or change. (u) Damage tolerance inspection. (DTI) means a documented inspection requirement or other maintenance action developed by holders of a type-certificate or restricted type- certificate as a result of a damage tolerance evaluation. A DTI includes the areas to be inspected, the inspection method, the inspection procedures (including the sequential inspection steps and acceptance and rejection criteria), the inspection threshold and any repetitive intervals associated with those inspections. DTIs may also specify maintenance actions such as replacement, repair or modification. (v) EASA. The European Union Aviation Safety Agency established by the European Council. (w) ELA1 aircraft. Means the following manned European light aircraft: Qatar Civil Aviation Regulation No. 1003/2006 v as amended by QCAR 097 of 2022 (i) an aeroplane with a maximum take-off mass (MTOM) of 1 200 kg or less that is not classified as complex motor-powered aircraft; (ii) a sailplane or powered sailplane of 1 200 kg MTOM or less; (iii) a balloon with a maximum design lifting gas or hot air volume of not more than 3 400 m 3 for hot air balloons, 1 050 m 3 for gas balloons, 300 m 3 for tethered gas balloons; (iv) an airship designed for not more than four occupants and a maximum design lifting gas or hot air volume of not more than 3400 m 3 for hot air airships and 1 000 m 3 for gas airships. (x) ELA2 aircraft. Means the following manned European Light Aircraft: (i) an aeroplane with a Maximum Take-off Mass (MTOM) of 2 000 kg or less that is not classified as complex motor-powered aircraft; (ii) a sailplane or powered sailplane of 2 000 kg MTOM or less; (iii) a balloon; (iv) a hot air ship; (v) a gas airship complying with all of the following characteristics: - 3% maximum static heaviness, - non-vectored thrust (except reverse thrust), - conventional and simple design of structure, control system and ballonet system, and - non-power assisted controls; (vi) a Very light Rotorcraft. (y) FAR. The US Federal Aviation Regulation. (z) Fatigue-critical baseline structure. (FCBS) means the baseline structure of an aeroplane that is classified by the type certificate holder as a fatigue-critical structure. (aa) Fatigue-critical modified structure. (FCMS) means any fatigue critical structure of an aeroplane introduced or affected by a change to its type design and that is not already listed as part of the fatigue-critical baseline structure. (ab) Flying display. As defined in QCAR 002/2016 Air Operations regulation. (ac) Human factors. Principles which apply to aeronautical design, certification, training, operations and maintenance and which seek safe interface between the human and other system components by proper consideration of human performance. (ad) Human performance. Human capabilities and limitations which have an impact on the safety and efficiency of aeronautical operations. Qatar Civil Aviation Regulation No. 1003/2006 vi as amended by QCAR 097 of 2022 (ae) ICAO. The International Civil Aviation Organisation of the Chicago Convention of 1944. (af) Introductory flight. As defined in QCAR 002/2016 Air Operations regulation. (ag) JAR. Means ‘Joint Aviation Requirements’. (ah) Limit of validity. (LOV) means, in the context of the engineering data that supports the structural maintenance programme, a period of time, stated as a number of total accumulated flight cycles or flight hours or both, during which it is demonstrated that widespread fatigue damage will not occur in the aeroplane. (ai) Limited operations. The operations of other-than-complex motor-powered aircraft for: (i) cost-shared flights by private individuals, on the condition that the direct cost is shared by all the occupants of the aircraft, pilot included and the number of persons sharing the direct costs is limited to six; (ii) competition flights or flying displays, on the condition that the remuneration or any valuable consideration given for such flights is limited to recovery of direct costs and a proportionate contribution to annual costs, as well as prizes of no more than a value specified by the Authority; (iii) introductory flights, parachute dropping, sailplane towing or aerobatic flights performed either by a training organisation having its principal place of business in the State of Qatar and approved in accordance with QCAR 002/2016 Air Operations, or by an organisation created with the aim of promoting aerial sport or leisure aviation, on the condition that the aircraft is operated by the organisation on the basis of ownership or dry lease, that the flight does not generate profits distributed outside of the organisation, and that whenever non-members of the organisation are involved, such flights represent only a marginal activity of the organisation; For the purpose of this Regulation, “limited operations” are not considered as CAT operations or commercial specialised operations. (aj) LSA aircraft. Means a light sport aeroplane which has all of the following characteristics: (i) a Maximum Take-off Mass (MTOM) of not more than 600 kg; (ii) a maximum stalling speed in the landing configuration (VS0) of not more than 45 knots Calibrated Airspeed (CAS) at the aircraft's maximum certificated take-off mass and most critical centre of gravity; (iii) a maximum seating capacity of no more than two persons, including the pilot; (iv) a single, non-turbine engine fitted with a propeller; (v) a non-pressurised cabin. (ak) Maintenance. The performance of tasks on an aircraft, remote pilot station, engine, propeller or associated part required to ensure the continuing airworthiness of an aircraft, remote pilot station, engine, propeller or associated part including any one or combination Qatar Civil Aviation Regulation No. 1003/2006 vii as amended by QCAR 097 of 2022 of overhaul, inspection, replacement, defect rectification, and the embodiment of a modification or repair. (al) Maintenance organization’s procedures manual. A document endorsed by the head of the maintenance organization which details the maintenance organization’s structure and management responsibilities, scope of work, description of facilities, maintenance procedures and quality assurance or inspection systems. Note - maintenance organization’s procedures manual in this Regulation is the maintenance organisation exposition. (am) Maintenance records. Records that set out the details of the maintenance carried out on an aircraft, engine, propeller or associated part. (an) Maintenance release. A document which contains a certification confirming that the maintenance work to which it relates has been completed in a satisfactory manner in accordance with appropriate airworthiness requirements. (ao) Modification. A change to the type design of an aircraft, engine or propeller. Note - A modification may also include the embodiment of the modification which is a maintenance task subject to a maintenance release. (ap) Management systems harmonization. means the coordinated process by which the management systems of two or more organisations interact and share information and methods to reach common or consistent safety and compliance monitoring objectives. (aq) Organisation. A natural person, a legal person or part of a legal person. Such an organisation may be established at more than one location whether or not within State of Qatar. (ar) Part. This Qatar Civil Aviation Regulation. (as) Part 21. The procedural or technical requirements and administrative procedures contained in the Annex to QCAR No. 1002/2006. (at) Pre-flight inspection. The inspection carried out before flight to ensure that the aircraft is fit for the intended flight. (au) Principal place of business. The head office or the registered office of the undertaking within which the principal financial functions and operational control of the activities referred to in this Regulation are exercised. (av) QCAR. Means Qatar Civil Aviation Regulation. (aw) Repair. The restoration of an aircraft, engine, propeller or associated part to an airworthy condition in accordance with the appropriate airworthiness requirements after it has been damaged or subjected to wear. (ax) Sign a maintenance release (to). To certify that maintenance work has been completed satisfactorily in accordance with appropriate airworthiness requirements, by issuing the maintenance release referred to in this Regulation. Qatar Civil Aviation Regulation No. 1003/2006 viii as amended by QCAR 097 of 2022 (ay) Widespread fatigue damage. (WFD) means a simultaneous presence of cracks at multiple locations in the structure of an aeroplane that are of such size and number that the structure will no longer meet the fail-safe strength or residual strength used for certification of that structure. Article 3 Continuing airworthiness requirements 1. The continuing airworthiness of aircraft referred to in point (a) of Article 1 and components for installation thereon shall be ensured in accordance with the requirements of Annex I (Part-M), except for aircraft listed in the first subparagraph of paragraph 2 to which the requirements of Annex Vb (Part-ML) shall apply. 2. The requirements of Annex Vb (Part-ML) shall apply to the following other than complex motor-powered aircraft: (a) aeroplanes of 2 730 kg maximum take-off mass or less; (b) rotorcraft of 1 200 kg maximum take-off mass or less, certified for a maximum of up to 4 occupants; (c) other ELA2 aircraft. Where aircraft referred to points (a), (b) and (c) of the first subparagraph is listed in the air operator certificate of a licensed air carrier, the requirements of Annex I (Part-M) shall apply. 3. In order to be listed in the air operator certificate of a licensed air carrier, aircraft referred to in points (a), (b) and (c) of the first subparagraph of paragraph 2 shall comply with all of the following requirements: (a) its aircraft maintenance programme has been approved by the Authority in accordance with point M.A.302 of Annex I (Part-M); (b) due maintenance required by the maintenance programme referred to in point (a) has been performed and certified in accordance with point 145.A.48 and 145.A.50 of Annex II (Part-145); (c) an airworthiness review has been performed and a new airworthiness review certificate has been issued in accordance with point M.A.901 of Annex I (Part-M). 4. By way of derogation from paragraph 1 of this Article, the continuing airworthiness of aircraft referred to in point (a) of Article 1, for which a permit to fly has been issued, shall be ensured on the basis of the specific continuing airworthiness arrangements defined in the permit to fly issued in accordance with Annex (Part-21) to Qatar Civil Aviation Regulation No. 1002/2006, as amended. 5. Aircraft maintenance programmes for aircraft referred to in point (a) of Article 1 that comply with the requirements specified in point M.A.302 of Annex I (Part-M) applicable before 24 Qatar Civil Aviation Regulation No. 1003/2006 ix as amended by QCAR 097 of 2022 March 2021 shall be deemed to comply with the requirements specified in point M.A.302 of Annex I (Part-M) or point ML.A.302 of Annex Vb (Part-ML), as applicable, in accordance with paragraphs 1 and 2. 6. Operators shall ensure the continuing airworthiness of aircraft referred to in point (b) of Article 1 and components for installation thereon in accordance with the requirements of Annex Va (Part-T). 7. The continuing airworthiness of aeroplanes with a maximum certificated take-off mass at or below 5 700 kg which are equipped with multiple turboprop engines shall be ensured in accordance with the requirements applicable to other than complex motor-powered aircraft as set out in points M.A.201, M.A.301, M.A.302, M.A.601 and M.A.803 of Annex I (Part-M), point 145.A.30 of Annex II (Part-145), points 66.A.5, 66.A.30, 66.A.70, Appendix V and VI of Annex III (Part-66), point CAMO.A.315 of Annex Vc (Part-CAMO), point CAO.A.010 and Appendix I of Annex Vd (Part-CAO) to the extent that they apply to other than complex motor-powered aircraft. 8. Without prejudice to the aforementioned provisions under this Article, when approving or accepting the approval of a maintenance organisation issued by another Contracting State to ICAO, the Authority shall ensure application of the provisions of Article 7 hereof. Maintenance Organisation whose approval is initially issued by another Contracting State and who seeks recognition and acceptance of such approval by the Authority shall comply with the ensuing process and requirements established in accordance with the provisions of Article 7, hereof. Article 4 Approvals for organisations involved in the continuing airworthiness 1. Organisations involved in the continuing airworthiness of aircraft and components for installation thereon, including maintenance, shall be approved, upon their request, by the Authority in accordance with the requirements of Annex II (Part-145), Annex Vc (Part- CAMO) or Annex Vd (Part-CAO), as applicable to the respective organisations. Acceptance of maintenance organisation approval issued by another Contracting State shall ensure compliance with the provisions of Article 7 hereof. 2. Organisations that hold a valid approval issued in accordance with Subpart F or Subpart G of Annex I (Part- M) or with Annex II (Part-145) shall, upon their request, be issued by the Authority a Form 3-CAO as set out in Appendix I to Annex Vd (Part-CAO) and thereafter be overseen by the Authority in accordance with Annex Vd (Part-CAO). The privileges of such an organisation under the approval issued in accordance with Annex Vd (Part-CAO) shall be the same as privileges under the approval issued in accordance with Subpart F or Subpart G of Annex I (Part-M) or with Annex II (Part-145). However, those privileges shall not exceed the privileges of an organisation referred to in Section A of Annex Vd (Part-CAO). Qatar Civil Aviation Regulation No. 1003/2006 x as amended by QCAR 097 of 2022 3. Organisations that hold a valid continuing airworthiness management organisation approval certificate issued in accordance with Subpart G of Annex I (Part-M) shall, upon their request, be issued by the Authority a QCAA Form 14 approval certificate in accordance with Annex Vc (Part-CAMO) and thereafter be overseen by the Authority in accordance with Annex Vc (Part-CAMO). 4. Certificates and aircraft maintenance programme approvals issued pursuant to QCAR 1003/2006 as applicable before 24 March 2021 shall be deemed to have been issued in accordance with this Regulation. 5. By way of derogation from points (1) and (2) of point 145.B.350(d) of Annex II (Part-145), a maintenance organisation that holds a valid approval certificate issued in accordance with Annex II (Part-145) may correct, until 2 December 2024, any findings of non- compliance related to the Annex II requirements introduced by QCAR 093 of 2022. Where after 2 December 2024 the organisation has not closed such findings, the approval certificate shall be revoked, limited or suspended in whole or in part. Article 5 Certifying staff 1. Certifying staff shall be qualified in accordance with the requirements of Annex III (Part- 66), except as provided for in points M.A.606(h), M.A.607(b), M.A.801(c) and M.A.803 of Annex I (Part-M), in points ML.A.801(c) and ML.A.803 of Annex Vb (Part-ML), in points CAO.A.040(b) and CAO.A.040(c) of Annex Vd (Part- CAO) and in points 145.A.30(j) of and Appendix IV to Annex II (Part-145). 2. Any aircraft maintenance licence and, if any, the technical limitations associated with that licence, issued or recognised by the Authority in accordance with the previous requirements and procedures and valid at the time of entry into force of this Regulation, shall be deemed to have been issued in accordance with this Regulation. 3. Certifying staff holding a licence issued in accordance with Annex III (Part-66) in a given category/sub- category are deemed to have the privileges described in point 66.A.20(a) of the same Annex corresponding to such a category/sub-category. The basic knowledge requirements corresponding to these new privileges shall be deemed as met for the purpose of extending such licence to a new category/sub-category. 4. Certifying staff holding a licence including aircraft which do not require an individual type rating may continue to exercise his/her privileges until the first renewal or change, where the licence shall be converted following the procedure described in point 66.B.125 of Annex III (Part-66) to the ratings defined in point 66.A.45 of this same Annex. 5. Conversion reports and Examination credit reports complying with the requirements applicable before this Regulation applies shall be deemed to be in compliance with this Regulation. 6. Until specific requirements for certifying staff for components are added to this Regulation, the requirements in force shall continue to apply, except for maintenance organisations Qatar Civil Aviation Regulation No. 1003/2006 xi as amended by QCAR 097 of 2022 located outside the State of Qatar where the requirements shall be approved by the Authority. 7. Limited certifying staff authorisations issued to flight engineer licence holders pursuant to point 145.A.30(j)(3) or (4) of Annex II (Part-145) before 2 December 2022 shall remain valid until they expire or until they are revoked by the maintenance organisation. Article 6 Training organisation requirements 1. Organisations involved in the training of personnel referred to in Article 5 shall be approved in accordance with Annex IV (Part-147) to be entitled: (a) To conduct recognised basic training courses; and/or (b) To conduct recognised type training courses; and (c) To conduct examinations; and (d) To issue training certificates. 2. Any maintenance training organisation approval issued or recognised by the Authority in accordance with the previous requirements and procedures, and valid at the time of entry into force of this Regulation shall be deemed to have been issued in accordance with this Regulation. For this purpose, by derogation from the provisions of 147.B.130(b) under Annex IV, level 2 findings associated with the differences between QCAR Part 147/2003 and Annex IV may be closed within one year. 3. Basic training courses complying with the requirements applicable before this Regulation applies may be started until 1 year after the date by which this Regulation applies. Basic knowledge examinations conducted as part of these courses may comply with the requirements applicable before this Regulation applies. 4. Basic knowledge examinations complying with the requirements applicable before this Regulation applies and conducted by the Authority or conducted by a maintenance training organisation approved in accordance with Annex IV (Part-147) while not being part of a basic training course, may be conducted until 1 year after the date by which this Regulation applies. 5. Type training courses and type examinations complying with the requirements applicable before this Regulation applies shall be started and finished not later than 1 year after the date by which this Regulation applies. 6. Type training courses approved before the approval of the minimum syllabus of certifying staff type rating training in the operational suitability data for the relevant type in accordance with Regulation 1002/2006 shall include the relevant elements defined in the Qatar Civil Aviation Regulation No. 1003/2006 xii as amended by QCAR 097 of 2022 mandatory part of that operational suitability data not later than 18 December 2017 or within two years after the operational suitability data was approved, whichever is the latest. Article 7 Acceptance of a maintenance organisation approval issued by another Contracting State to ICAO 1. For the purpose of the provision of Article 3 (6) and in pursuant to the provisions of Article 40 of Law 15/2002 as amended, the Authority may accept, in whole or in part, a Maintenance Organisation Approval issued by another Contracting State. 2. In such a case, the Authority shall: (a) issue a Certificate of Acceptance to the Maintenance Organisation on the basis of the Maintenance Organisation Procedures Manual or equivalent approved by the Contracting State that initially issued the approval; and compliance by the Maintenance Organisation with the established process and requirements for the recognition of such approval and successive changes. (b) build an adequate liaison with the Competent Authority of the Contracting State that initially issued the maintenance organisation approval. 3. The Authority recognizes the standards and requirements of EASA IR Part-145, U.S. FAR Part 145 and Transport Canada CAR 573 as equivalent to that prescribed in Annex II (Part-145) to this Regulation, as amended. Maintenance Organisation Approval issued in accordance with either of these standards and requirements are recognised by this Authority, provided that: - for complete aircraft, the approval of the maintenance organisation is accepted by this Authority in accordance with the provisions under this Article. for acceptability of component and materials, the airworthiness release certificate issued by the maintenance organisation is acceptable in accordance with the requirements of QCAR 1002/2006 Subpart K, except as required in point 21.A.311, thereof, for complete engine and APU where the maintenance organisation is required to be accepted by the Authority in accordance with the provisions under this Article. 4. The acceptance by the Authority of a maintenance organisation approval issued by the Competent Authority of another Contracting State shall be determined and shall be based upon satisfactory result of the recognition process established by the Authority. Article 8 Competent authority 1. Pursuant to Article 4 of Law No. 15 of 2002, as amended, the Qatar Civil Aviation Authority (QCAA) is the competent authority with the necessary powers and allocated Qatar Civil Aviation Regulation No. 1003/2006 xiii as amended by QCAR 097 of 2022 responsibilities for the certification and oversight of persons and organisations subject to this Regulation. 2 The QCAA shall ensure that it has the necessary capability to ensure the oversight of all persons and organisations covered by its oversight programme, including sufficient resources to fulfil the requirements of this Regulation. 3. The QCAA shall ensure that their personnel do not perform certification and oversight activities when there are indications that this could result, directly or indirectly, in a conflict of interest, in particular when relating to family or financial interest. 4. Where necessary to carry out certification or oversight tasks under this Regulation, the Authority shall be empowered to: (a) examine the records, data, procedures, and any other material relevant to the execution of the certification and/or oversight tasks; (b) make copies or extracts from such records, data, procedures and other material; (c) ask for an oral explanation on-site from any of the personnel of those organisations; (d) enter relevant premises, operating sites or means of transport owned or used by those persons; (e) perform audits, investigations, assessments, inspections, including unannounced inspections, in respect of those organisations; (f) take or initiate enforcement measures as appropriate. 5. The powers referred to in paragraph 4 shall be exercised in compliance with the legal provisions of Law No. 15 of 2002, as amended. Article 9 Waiver or exemption (1) Waiver or exemption may be issued by the Authority to any technical requirements contained in the Annexes to this Regulation under this Article, providing that, such a waiver or exemption shall only be applicable to that particular technical requirement. When such waiver or exemption is granted, it shall be deemed to have been issued under the Civil Aviation Law and in accordance with the established rule and ensuing procedures. (2) For the purpose of this Article, no waiver or exemption shall be granted to any provisions pertaining to offences, violations or acts committed against any mandatory provisions of the Civil Aviation Law and from those that prescribed enforcements and penalties. (3) No waiver or exemption shall be granted to any provision or requirements of this Regulation that may invalidate any international treaties or bilateral agreements entered into by the State of Qatar. Qatar Civil Aviation Regulation No. 1003/2006 xiv as amended by QCAR 097 of 2022 Article 10 Amendments and revision (1) Revision may be made by the Authority to the technical requirements and administrative procedures contained in the Annexes to this Regulation resulting from any future International Standards changes in the airworthiness related Annexes in ICAO that the Authority may adopt. (2) When such revision is made, the Authority shall ensure that the aeronautical industry shall be made aware of such revision in accordance with the rulemaking method or process that the Authority may establish. (3) By derogation from paragraph 1 and 2, the Authority may however, amend, revise, supersede, revoke or cancel this Regulation in part or in whole in accordance with established rule and rulemaking process. Article 11 Entry into force (1) This Regulation shall enter into force on the day following its publication in the QCAA website. (2) By way of derogation from paragraph 1, for aeroplanes of 5 700 kg MTOM and below which are equipped with multiple turboprop engines and which are not involved in commercial operations, points M.A.201(g)(2) and (g)(3) of Annex I (Part-M) shall apply from 1 January 2025. (3) By way of derogation from paragraph 1, for the maintenance of ELA1 aeroplanes not involved in CAT operations and of aircraft other than aeroplanes and helicopters: (a) the requirement for the Authority to issue aircraft maintenance licences in accordance with Annex III (Part-66), as new or as converted, pursuant to point 66.A.70 of that Annex, shall apply from 1 October 2019; (b) the requirement for certifying staff to be qualified in accordance with Annex III (Part-66) laid down in points M.A.606(g) and M.A.801(b)(2) of Annex I (Part-M) and in point 145.A.30(g) and (h) of Annex II (Part-145) shall apply from 1 October 2020. SECTION A TECHNICAL REQUIREMENTS Qatar Civil Aviation Regulation No. 1003/2006 Page 2 of 407 as amended by QCAR 097 of 2022 SUBPART A - GENERAL M.A.101 Scope This Section establishes the measures to be taken to ensure that airworthiness of aircraft is maintained, including its maintenance. It also specifies the conditions to be met by the persons or organisations involved in such continuing activities. SUBPART B - ACCOUNTABILITY M.A.201 Responsibilities (a) The owner/operator is shall be responsible for the continuing airworthiness of an aircraft and shall ensure that no flight takes place unless all of the following requirements are met: 1. the maintenance on the aircraft including any associated engine, propeller and part, is carried out: i) by a maintenance organisation complying with this Regulation that is either approved by this Authority or is approved by another Contracting State and is accepted by this Authority; or ii) by a person or organisation in accordance with procedures that are authorized by this Authority; and there is a maintenance release in relation to the maintenance carried out. 2. any operational and emergency equipment fitted is correctly installed and serviceable or clearly identified as unserviceable, and; 3. the airworthiness certificate is valid, and; 4. the maintenance of the aircraft is performed in accordance with the AMP as specified in M.A.302. (b) When the aircraft is leased, the responsibilities of the owner are transferred to the lessee if: 1. the lessee is stipulated on the registration document, or; 2. detailed in the leasing contract. When reference is made in this Part to the ‘owner’, the term owner covers the owner or the lessee, as applicable. Qatar Civil Aviation Regulation No. 1003/2006 Page 3 of 407 as amended by QCAR 097 of 2022 (c) Any person or organisation performing maintenance shall be responsible for the tasks performed. (d) The pilot-in-command or, in the case of aircraft used by licensed air carriers, the operator shall be responsible for the satisfactory accomplishment of the pre-flight inspection. This inspection shall be carried out by the pilot or another qualified person and shall not need to be carried out by an approved maintenance organisation or by certifying staff. (e) In the case of aircraft used by licensed air carriers, the operator is shall be responsible for the continuing airworthiness of the aircraft it operates and shall: 1. ensure that no flight takes place unless the conditions set out in point (a) are met; 2. take the necessary steps to ensure its approval as a continuing airworthiness management organisation (‘CAMO’) pursuant to Annex Vc (Part-CAMO) or Subpart G of this Annex (Part-M), as part of air operator certificate for the aircraft it operates; 3. take the necessary steps to ensure its approval in accordance with Annex II (Part-145) or conclude a written contract in accordance with point CAMO.A.315(c) of Annex Vc (Part-CAMO) or point (M.A.708(c) of this Annex (Part-M) with an organisation which has been approved in accordance with Annex II (Part-145). (ea) By derogation to point (e)(2), at least two operators forming part of a single air carrier business grouping may use the same CAMO to assume the responsibility for the continuing airworthiness management of all the aircraft they operate, provided that all of the following requirements are met: 1. the CAMO is approved in accordance with Annex Vc (Part-CAMO) for the aircraft to be managed; 2. the CAMO forms part of the same air carrier business grouping as the operators concerned; 3. a contract is established in accordance with Appendix I to this Annex between the CAMO and the AOC holder not itself approved as a CAMO; 4. the CAMO has its principal place of business in the territory to which the Treaties apply; 5. the individual management systems of the organisations concluding a contract are harmonised with each other. (eb) By derogation to point (e)(2), when the termination or revocation of an air operator certificate results in a situation where a licensed air carrier and forming part of an air carrier business grouping is no longer in compliance with point M.A.201(ea), that licensed air carrier shall define and implement an action plan to the satisfaction of the competent authority to comply with point M. A.201(e)(2) as soon as practicable.
