Airworthiness Directives

U.S. DEPARTMENT OF TRANSPORTATION ORDER FEDERAL AVIATION ADMINISTRATION 8040.1D National Policy Effective date: SUBJ: Airworthiness Directives 1. Purpose of This Order. This order sets forth Federal Aviation Administration (FAA) policy, authority, and responsibility for the development of Airworthiness Directives (ADs) in accordance with applicable statutes and regulations.

2. Audience. All Aviation Safety (AVS) Aerospace Engineers, Aviation Safety Inspectors, Office of Rulemaking, Office of the Chief Counsel (AGC), and Office of Information Services.

3. Where Can I Find This Order? You can find this order, and other FAA documents referenced in this order, on the FAA employee website , on the FAA public website , and in the FAA Dynamic Regulatory System (DRS) .

4. Cancellation. This order cancels FAA Order 8040.1C, Airworthiness Directives , dated October 3, 2007.

5. Explanation of Policy Changes. This order incorporates the following changes: a. Updates references to organizational names to reflect organizational changes.

b. Updates obsolete order references.

c. Adds administrative and feedback appendices.

6. Airworthiness Directives (AD) Manual. The FAA-IR-M-8040.1, Airworthiness Directives Manual , provides detailed processing procedures for the development, issuance, and distribution of ADs. The AD Manual is to be used in conjunction with this order.

7. Issuing Authority.

a. FAA Order 1100.154, Delegations of Authority , delegates the authority to issue ADs to the directorate managers of the Aircraft Certification Service (AIR). In 2017, AIR realigned from a directorate structure to a functional division organization. FAA Order 8000.51, Aircraft Certification Service Delegation of Authority , authorizes the Director, AIR (now the Executive Director) and the successor functional divisions the authority to issue ADs. The current AIR organizational structure is defined in FAA Order 8100.5, Aircraft Certification Service – Organizational Structure and Functions.

b. In accordance with FAA Order 1100.1, FAA Organization – Policies and Standards , while AVS is responsible for the continued operational safety of aircraft, which includes Distribution: Electronic Initiated By: AIR-633 8040.1D developing the substance of ADs, AGC is responsible for approval as to form and legality of all FAA rules, including ADs.

8. Statutory and Regulatory Basis. Title 49 of the United States Code (49 U.S.C.) Chapter 447 defines the Administrator's powers and duties regarding the promotion of safety of flight of civil aircraft. Title 14 of the Code of Federal Regulations (14 CFR) part 39 establishes the legal framework for ADs, including when and why ADs are issued. Title 14 CFR part 11 prescribes the procedures to be followed in FAA rulemaking actions, including ADs.

This order is distributed to the Associate Administrator for Aviation Safety; the division level in the Office of Rulemaking, the Office of Accident Investigation and Prevention, and the Office of the Chief Counsel; the branch level in the FAA Academy and the Flight Standards Service divisions, including the Aircraft Evaluation Division; and the division and branch levels in the Aircraft Certification Service (AIR).

A-2. Authority to Change This Order. The Executive Director, AIR, may authorize changes to this order and the AD Manual.
