ORDER NUMBER JO 8200. 3C Effective Date: 09/19/2022 SUBJ: Flight Inspection of Foreign - Owned Air Navigation Facilities 1. Purpose of T his O rder . This order establishes Flight Program Operations (AJF - 0) policy for the addition, deletion, and annual requirements of flight inspection activities deemed essential to U.S.
military operatio ns conducted on foreign - owned air navigation aids (NAVAIDs) by the Federal Aviation Administrati on (FAA).
2. Audience. This order affects the following FAA offices: a. Office of International Affairs (API - 001) ; b. Flight Program Operations Control Center ( OCC ) ; and c. Aircraft Operations (AJF - 1000).

5. Explanation of Policy Changes . This order revises the annual DoD Essential List publication .
This document integrates u pdated processes due to lessons learned whi le supporting DoD Operations in Southwest Asia . It clarifies the criteria for military authorities to have foreign - owned NAVAIDs, approach procedures, and data that support those facilities and the procedures to be flight inspected .
This order adds the req uirement for military authorities to provide a letter signed at no lower than the Distribution: Electronic Initiated By: AJF - 0 09/19/22 JO 8200.3C O-6 level indicating the appropriate process has been completed prior to submitting a facility to be included in the DoD Essential List for flight inspection. The order retains the requirement for an annual review and extends the two-year limitation to keep NAVAIDs on the list to three years. The extension to three years better aligns with the inspection periodicity in FAA Order 8200.1 United States Standard Flight Inspection Manual. Finally, this order updates conditions under which the FAA will flight inspect a foreign-owned NAVAID.
6. Objective. The FAA will provide the DoD flight inspection capability on a non-reimbursable basis to properly justified foreign-owned NAVAIDs, deemed essential to DoD operations, while preserving FAA effective and efficient operations with the low-density/high-demand flight inspection resources.
7. Department of Defense Pre-Flight Inspection Requirements (Justification Process). Military requests for flight inspection of foreign-owned NAVAIDs designated as essential to U.S. military operations will be made by the appropriate operational authority (no lower than an O-6), and routed to the Executive Director, DoD Policy Board on Federal Aviation. The Executive Director will review the request and forward to the FAA Flight Program Executive ensuring the following criteria are met prior to a foreign-owned NAVAID being added to the list for flight inspection: a. The DoD sponsoring organization will verify there is a valid operational use. There should be a direct correlation between a NAVAID and missions supported. Designation as an Essential NAVAID is typically reserved for host nation-owned facilities located with/within forward U.S. operating bases, and have uncertain calibration and inspection status. NAVAIDs that are calibrated to ICAO Annex 10 Vol 1 and ICAO 8071 requirements or meet or exceed FAA Order 8200.1 United States Standard Flight Inspection Manual standards will not be considered. If a host nation is able to maintain the aforementioned ICAO or FAA safety standards for a NAVAID, a host nation NAVAID should be not be designated as an essential NAVAID due to limited flight inspection resources. The FAA absorbs the cost of all DoD Essential List flight inspections and has finite resources.
b. The DoD sponsoring organization will review and approve all survey and facility data supporting the requested NAVAID for accuracy before it will be included on the list and flight inspected.
c. The DoD sponsoring organization will review and approve all data supporting approach procedures, such as lights, Distance Measuring Equipment DME), etc., associated with a NAVAID on the DoD Essential List for accuracy before the procedure will be included in the essential program and flight inspected.
d. The DoD sponsoring organization will review all associated procedures for Terminal Instrument Procedures (TERPS) or Procedures for Air Navigation Services (PANSOPS) criteria along with data and procedural accuracy. The DoD sponsoring organization will approve all associated procedures designed by any commercial or governmental organizations other than FAA or DoD. After the FAA receives a signed coversheet with the standard FAA procedure package, the procedures will be included on the list and flight inspected.
e. In all cases, the DoD sponsoring organization will provide a signed cover letter to the FAA Flight Program Executive through the Executive Director, DoD Policy Board on Federal 09/19/22 JO 8200.3C Aviation once the appropriate review has been completed. A sample letter is available on page 4.
f. The approved justification results in a NAVAID being included on the DoD Essential List for flight inspection for three years. The DoD Essential List will track the date the facility is added to the list, along with the expiration date.
g. Annual reviews are completed to verify validity of the requirement to retain or remove a NAVAID on the DoD Essential List. This is also a suitable time to add new NAVAIDs to the list. However, NAVAIDs can be added anytime outside of the annual review cycle to meet DoD requirements.
h. Annual reviews should be competed and transmitted to Flight Program Operations no later than 1 December each year.
i. The DoD sponsoring organizations will be prepared to respond to FAA queries when the FAA conducts NAVAID reviews.
09/19/22 JO 8200.3C Sample Letter to Add, Remove, or Renew a NAVAID to the DoD Essential List 09/19/22 JO 8200.3C 8. Federal Aviation Administration Responsibilities.
a. The DoD Essential List is an ongoing collaboration with DoD that Flight Program Operations will support to enable DoD operations.
b. Flight Program Operations will include the expiration date on the annually approved list.
c. Flight Program Operations will review and publish the DoD essential NAVAID list.
d. The review will be coordinated with the appropriate service headquarters and the Executive Director, DoD Policy Board on Federal Aviation. The annually published list will be dated and signed by the Flight Program Operations Director of Aircraft Operations.
e. Flight Program Operations will only flight inspect NAVAID facilities if one of the conditions exist: (1) The facility is DoD/U.S. owned, (2) The facility is on the DoD Essential List, or (3) There is a reimbursable agreement in place to perform the requested work.
f. The FAA reserves the right to review and remove a NAVAID from the DoD Essential Program should it be found that the NAVAID is currently inspected and maintained to either U.S. or ICAO Annex 10 standards. The FAA will engage with the Executive Director, DoD Policy Board on Federal Aviation prior to any removal to discuss review findings.
g. The process described in Paragraph 8.c.(2) is detailed in the flowchart on Page 6.
09/19/22 JO 8200.3C Flight Inspection of Foreign-Owned NAVAID Flowchart 9. NAVAID Removal. Foreign-owned NAVAIDs will be removed from the DoD Essential List after three years unless the DoD sponsor justifies the need to remain on the DoD Essential List.
10. Emergency Flight Inspection Requests. Flight Program Operations responds to emergency flight inspection of foreign-owned air navigation facilities requests from DoD or to combat/contingency operations requests from allied nations/partner nations. The inspections are done when the request has been approved through appropriate U.S. command levels and DoD has obtained the necessary concurrence of the foreign government for FAA aircraft and aircrews to perform the requested inspections. In the case of an emergency request, the FAA will request a waiver of the advanced payment requirement. Upon approval of that request or receipt of the advanced payment, Flight Program Operations will execute the inspection. Following these inspections, the FAA Flight 09/19/22 JO 8200.3C Program Executive will promptly report to the FAA Administrator and the Office of International Affairs when any emergency flight inspection is provided.
11. Host Nation Assuming Flight Inspection of NAVAIDs formerly on DoD Essential List. When the DoD has successfully negotiated for the host nation government to perform flight inspection of NAVAIDs currently in the DoD essential list, the facility will be removed. Flight Program Operations will coordinate a smooth transition to a foreign country assuming flight inspection responsibility of the NAVAID. This will include, but not be limited to: a. Flight Program Operations coordinates the transition with appropriate service headquarters and the Executive Director, DoD Policy Board on Federal Aviation.
b. Flight Program Operations supplies the country with copies of past flight inspection reports on the facility when requested.
c. Flight Program Operations supplies the country with flight inspection schedules and current periodic interval for the facility when requested.
d. Flight Program Operations supplies the country with the NAVAID survey data used for the past flight inspections.
e. When the FAA and/or DoD determine the host nation can accept responsibility for flight inspection, the host nation may conduct flight inspection directly or through another entity. If the host nation requests that the FAA provide flight inspection services, the FAA Office of International Affairs will conduct negotiations through the Department of State (DOS) to conclude the appropriate agreement with the host nation. Otherwise, the host nation then assumes all responsibility. The DoD is responsible for immediately informing the DOS, FAA Office of International Affairs, and the appropriate foreign government whenever any foreign- owned air navigation facility is removed from the DoD essential NAVAID list.
12. Distribution. This order is distributed to the Executive Director, Department of Defense Policy Board on Federal Aviation, the executive offices of the U.S. Military Services, the Office of International Affairs, and Flight Program Operations.
