ORDER U.S. DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION 1110.156 ~ ftective Date: 06/15/18 SUBJ: Charter of the NextGen Advisory Committee 1. Committee's Official Designation. The ommittee's official designation is the NextGen Advisory Committee (NAC).
2. Authority. The Committee is established under the authority of the U .. Department of Transportation (DOT). in accordance \: ith the provisions of the Federal Ad i or Com mi nee Act (F ACA). a amended, Pub. L. 92-463, 5 . .C. App. The ecretary of Transportation has detennined that the establishment of the Committee is in th e public interest.
3. Objective and Scope of Activities. The objective of the NAC is to provide independent advice and recommendations to the Federal Aviation Admini tration (FAA) and to respond to specific ta king received direct! from the FAA. The ad, ice. recommendation . and taskings relate to concepts requirement , operational capabilities. the as ociated use of technology, and related considerations to operations that affect th e future of the Air Traffic Management System and th e integration of new techno logies. [n addition, the NAC recom mends consensus-driven standards for the FAA consideration relating to Air Traffic Management System modernization.

4. Description of Duties. The objective of the AC is to ad i e the FAA. using consensus based meeting methodologies, on (1) investment priorities (2) NcxtGen priorities a nd performance analyses reports. (3) trajectory-based operations deployment and planning consistent with the FAA 's NextGen Vision. and (4) ad hoc taskings received directly from the FAA. The NAC will act solely in an ad i or capacity and will not exercise program management responsibilities. Decisions direct! affecting implementation of tr an po1tation policy will remain with the FAA Administrator and the Secretar of Transportation.
5. Agency or Official to Whom the Committee Reports. The NAC reports to th e Secretary of the Dep artment of Transportation (DOT) through the FAA Adm inistrator.
6. Support. The FAA \: ill pro ide support a consistent, ith the act. including funding for th Committe . or the period of this charter the F A plans to utilize contractual upport to provid for logistics and administrative support.
7. Estimated Annual Operating Costs and Staff Years. The r AA· s annual operating costs to
support the AC for the period and scope specified by the charter, ill not exce d $670,000 including th salary and b nefits of 1.0 full-time equi alent FT ).

The FAA Ad ministrator. on behalf of the Secretary of Transportation wi ll appoi nt a full-time federal employee to serve as the NAC Designated Federal Officer (DFO). The NAC DFO w ill ensure that adm ini strati ve s up port is provided fo r all activities. The Designated Federal Officer will: a. Ensure compliance w ith FACA and any other app li cable laws and regulations.
b. Call and attend a ll the co mmi ttee and subcommi tt ee meetings.
c. Formulate and approve, in consultation wi th th e Chair, all committee and subcommittee agendas.
d. Notify all Committee members of th e tim e, place. and agenda fo r any meeting.
e. Maintain membership records.
f. Ensure efficient operations. in cluding ma intaining itemized contractor invoices.
g. Maintain a ll NAC records and files.
h. Adjourn any meeting when doing so would be in the public interes t.
i. Chair meet in gs when directed to do so by th e FAA Adm ini strato r.
9. Estimated Number and Frequency of Meetings. Th e committee wi ll meet as fo ll ows: a. The NAC w ill meet 3 times per year to carry out its responsibi lit ies.
b. Meetings of the NAC wi ll be a nn ounced in the Feder al Register at least 15 days before each me eting, unless exceptional circumstances require shorter notic e. Such circumstances will be expla in ed in the notice. NAC meetings will be open to th e public, except as provided by section IO(d ) of the FACA a nd applicable r egu lations. T he NAC w ill publish an annual report summa ri zing activities held in closed or partia ll y closed meetings, consistent w ith th e policies or th e Freedom of In formation Act.
c. Anyone inte re sted may attend committee meetings a nd appear before th e NAC within reasonable limits of space and time. Additionally. anyone interested may file w ri tten statements with the committee.
10. Duration. Subject to renewal every 2 years.
11. Termination. Th e cha rt er will terminate 2 years after its effecti ve date u nl ess renewed in acco rd ance with FACA and other applicable r eq uiremen ts. If the NAC is terminated. the FAA will give as much advance notice as possible of s uch action to all participants.
12. Membership and Designation. The FAA w ill submit recommendations for membership to th e Secretary of Transportation. who w ill appoint members to the NAC. A ll NAC members serve at the pleasure of the Secretary of Transportation.

b. Members may serve as representatives or as Regular Government Employees.
Jndividuals will be appointed as representatives if they wou ld represent a particu lar inte rest of emp lo yment, education, experience, or affi li at ion with a specifi c aviation-related organization.
Representative members will serve without charge, and without government co mpensation. The empl oy i ng organization bears a ll costs related to its participation. They must r ep r ese nt a partic ul ar interest of employment, education, experience, or affiliation with a specific avia tion related organjzation.
c. Federal emp loyee m em bers will serve as Regular Governm ent Em pl oyees and will be e li gible for travel and per di em reimbursement by their respec ti ve agency.
13. Subcommittees. The NAC DF O has the authority to create and dissolve subco mmitt ees, as needed. Subcommittees will not wo rk independently of the NAC. Th ey must provide reco mm endations and advice to the NAC, not the FAA, for deliberation, discu ss ion, and approval.
14. Recordkeeping.
a. The records of the committee and subcommittee will be handl ed in accordance ·w ith the General R ecor ds Schedule 6.2, or other approved age n cy records disposi ti on sch ed ul es .
b. The se records will be ava il able fo r publ ic inspec ti on and copying, subj ect to the Freedom of In fom 1 at ion Act, 5 U.S.C. 552. Th e records, r epo rts, transcripts, minutes, and other documents that are made available to or provid ed for or by the NAC are ava il ab le fo r pub li c inspection at www. fa a.go v/ re £1.ul a ti o ns po li cies.
15. Filing Date. This charter is effective June 15, 2018, the date on w hi ch it was filed with Congress. This Committee will remain in existence for 2 years after t hi s date unless soo n er terminated or renewed.
